Refer-a-Friend Program Terms and Conditions

By participating in teleCalm’s Refer-a-Friend program (“Program”), you agree to abide by these Refer-a-Friend Terms and Conditions, the teleCalm Terms of Service, and the teleCalm Privacy Policy (collectively referred to as the “Terms”) 

Eligibility 

The Program is open to active teleCalm customers. Both teleCalm customers and those they refer must be legal residents of the U.S and at least the age of majority in their jurisdiction of residence. 

To participate in the Program, teleCalm customer accounts must be in good standing, with no outstanding balances. Should the customer’s account be put on hold or canceled due to non-payment, they will be unable to make referrals, accrue awards, and will also lose previously earned awards.

The Program is exclusively available to individual teleCalm customers and not intended for use by businesses or organizations for the purpose of affiliate lead generation, and eligibility in such cases is subject to teleCalm’s final determination.

Employees of teleCalm and their immediate family members are not eligible to participate.

Referral Rewards 

For each qualifying referral that results in a new, confirmed customer for teleCalm, the Referring User (“Referrer”) may receive their choice of awards valued at $30. These choices may include Amazon, Visa or other gift cards, or allow the Referrer to choose from participating charities for the award to be donated to. The available award choices may change from time to time without notice. Referrer will receive award no earlier than fifteen (15) days after the referred Friend has successfully subscribed to teleCalm service. Should the Friend decide to cancel the service prior to the award being issued, the award will be canceled.

The Referred Friend (“Friend”) may also receive a credit equivalent to one month’s service, contingent on the subscription plan selected. This credit will be applied to the Friend’s account no earlier than fifteen (15) days following a successful subscription to the teleCalm service. Account credits can only be used for service plan payments and are not redeemable for cash. Should the Friend decide to cancel the service prior to the application of the credit, the credit be forfeited.

Qualifying Referral

A referral qualifies when it adheres to the stipulated Program guidelines. To be eligible, the referred individual must be a first-time teleCalm customer, initiating their subscription directly via the teleCalm website (teleCalmProtects.com). Please note, subscriptions activated through affiliates, partners, or any external websites are excluded from this referral program.

In the event that a Friend is recommended by multiple Referrers, the reward will be granted exclusively to the Referrer who made the first recommendation. 

Additionally, to qualify for a referral award, the Friend must not have any prior interactions or communications with teleCalm. Should there be a pre-existing relationship or prior discussions regarding services with teleCalm, the Friend is considered ineligible for referral by a Referrer.

Award Limitations

With each qualifying referral, Referrers may potentially be awarded for each referral up to a maximum of 20 awards per calendar year (i.e., January 1st to December 31st), with a maximum of $600 in awards each year. Awards are non-transferable and cannot be exchanged for cash. Awards may be subject to expiration; please check the specifics of your award for more details. 

Referral Links

Referrers will receive a unique Personal Referral Link URL (“Link”) to share with Friends. To accept the referral offer, Friends must click on the Link, submit their email address via the provided form, and then use that same email to subscribe to teleCalm services. This process ensures that both the Referrer is eligible for an award and the Friend receives their referral credit seamlessly.

This Program is void where prohibited by law.

YOU EXPRESSLY AGREE THAT YOUR PARTICIPATION IN THE PROGRAM IS AT YOUR OWN RISK. THE PROGRAM IS MADE AVAILABLE TO YOU ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND. TELECALM SPECIFICALLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL TELECALM BE LIABLE FOR SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR DAMAGES FOR LOSS OF PROFITS, REVENUE, USE, OR DATA AS A RESULT OF CLAIMS, WHETHER BROUGHT IN CONTRACT OR TORT, ARISING OUT OF OR CONNECTED WITH THESE PROGRAM TERMS OR THE PROGRAM, EVEN IF CLIENT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

Program Changes and Termination

teleCalm reserves the right to change or terminate the Program at any time, without notice. If the Program is terminated, any unredeemed rewards will be forfeited.

Participants agree to receive communications from teleCalm via SMS, email, and phone calls at the contact information provided. Message frequency may vary. Standard message and data rates may apply for SMS messages. A participant can opt out at any time by replying STOP to any of our SMS messages, clicking the unsubscribe link in our emails, or informing our customer service representative during a phone call. For help, reply HELP to any SMS message or contact our customer service at the email or phone number listed on our Contact Us page. We respect your privacy and will not share your information with third parties without your consent.

Compliance with Laws

Participants agree to comply with all applicable laws and regulations, including but not limited to, anti-spam laws. Any distribution of the Link that could constitute unsolicited commercial email or “spam” under any applicable law or regulation is expressly prohibited and will be grounds for immediate exclusion from the Program.

Liability Release

Participants release teleCalm, its affiliates, subsidiaries, directors, officers, employees, and agents from any and all liability with respect to the Program and the redemption and use of any rewards.

Data Privacy

Participants agree to the collection, processing, and use of their personal data by teleCalm for the purposes of the Program. Please refer to our Privacy Policy for more information on how we handle your data.

Agreement to Terms

By participating in the Program, you are agreeing to these Terms. If you do not agree to these Terms, please do not participate in the Program.

These Terms constitute the entire agreement between participants and teleCalm regarding the Program. If any part of these Terms is found to be unenforceable, the remaining portions will remain in full force and effect.

teleCalm reserves the right to change, alter, or modify these Terms at any time, without notice, and at our sole discretion.

These Terms shall be governed in all respects in accordance with the laws of the State of Texas without regard to the conflict or choice of law rules thereof. The federal and state courts in Denton County, Texas shall have exclusive jurisdiction over any dispute arising hereunder and by participating in the program you consent to same.
